After Bombay HC rap, Thane police vow to file FIR by May 3 in Badlapur custodial death case

The Thante Police on Wednesday assured the Superior Court of Bombay that it would register a FIR in the case of death by custody of Badlapur for May 3 after the Court rebuked him by the Special Investigation Teams (SIT) not to reserve the personnel of the five defendants.

A Division Bank of Judges Revati Mohite Dere and Neela Gokhale accepted the statement presented by public prosecutor Hiten Venegaonkar, whose court expressed his discontent for the reasoning of the SIT for not staying in the FIR.

The SIT had summoned that the victim’s parents, Akshay Shindy, accused in the case of Badlapur’s sexual assault were waiting for a formal complaint.

The bank said that if the petitioner may withdraw the plea, it did not mean that the parents had no complaint or that a FIR would not appear.

“This is the misuse of the Court’s time. The state of affairs is very unfortunate. There is a responsibility in the police. This is a complete challenge of our order,” said the bank.

The court said the police had the duty to act independently and fairly in such cases.

The court indicated that the CID had delivered the documents in the case to the SIT on April 25, giving him four days to take measures.

‘Confirmation procedures’

“Do not let the public faith in the system down. There is a body. It is an unnatural death. What more revelation do you want to accommodate? [an] Fir? A cognable crime is committed; You should have fulfilled the orders of the Court. We have no choice but to start contempt processes, “he said.

Mr. Venegaonkar informed the bank that Police Inspector Mangesh Desai was nominated as a plaintiff in the case. He would review the documents, after which his statement would be recorded as the complaint, and the Firwold will be presented before May 3.
