Bengal SSC scam: The Supreme Court annulled on Tuesday the order of the Superior Court of Calcuta of a CBI investigation into the decision of the Western Bengal Government to create 6,861 additional positions for teachers and non -teaching staff in the process of the School Service Commission.
The president of the Court of India, Sanjiv Khanna, said that the courts are forbidden to direct an investigation into decisions by the cabinet. He also described the ruling of the higher courts as “incorrect.”
“Taking into account the aforementioned discussion of the opinion that the Superior Court of Calcutta was not justified by sending the issue of creating supernumerary positions to CBI in accordance with the Cabinet decision,” said the CJI.
The Apex court ruling occurred as a great relief for Mamata Banerjee and its cabinet, who have been under fire after the dismissal of 25,753 to the teaching and non -teaching staff of the Government and Government schools.
“We take note of article 74 and 163 (3) that specifically establishes that the question of anyone and, if so, what advice were tasks of the Cabinet of Ministers for the help and advice of the Government should not be investigated in any route,” Heyidaid.
In its previous order, the Superior Court exceeded the order of the Superior Court of Calcutta that canceled the 24,000 appointments of teaching and non -teaching personnel by the School Service Commission of Western Bengal (WBSSC) in 2016 in relation to school works for cash scam.
A Bank of CJI Sanjiv Khanna and Judge PV Sanjiv Kumar refused to interfere with the decision of the Superior Court, noting that the appointments were vitiated by “manipulation and fraud.”
Shortly after, Banerje said he won the court verdict and also promised to support the teachers who were fired from his works as a result of the ruling of the Supreme Court.
“Do not think that we have accepted this [decision]. Our heart is also painful for your complaint. We are all human, and our hearts are not made of stone. This is why they could in jail for saying this, but I don’t care, “Banerjee said.
“When Oneone is in trouble, we do not need to see who is red, white, yellow or green. We are supposed to be by his side. We cannot deny the responsibility of restoring his dignity and respect they are,” Shee added.
The main minister announced that his government has “separate plans” to ensure that eligible candidates are not unemployed or have any rest at work.
