The Superior Court of Madras recently criticized the Department of National Roads for excessive delay in the processing of the request of a compassionate appointment widow, calling corruption as a general domain within the government.
A division bank of Judges R Subramanian and G Aul Murugan made these observations by getting rid of a written appeal presented by a Gowdham, who sought a compassionate appointment after the death of his father, an employee record on the roads.
At the time of his father’s disappearance, Gowdham was a minor, and the only eligible candidate was his mother, TMT. Amudha, who requested the work in January 2018. Surprisingly, the department played almost 34 months to respond, a delay that the court observed without explanation. When the authorities finally responded in October 2020, they sought new certificates, including income test documents and educational qualification. Given this bureaucratic inertia, Amudha expressed his desire to nominate his son for work.
By then, Gowdham had completed his education and reached the majority. He requested in his own name in November 2022, but the department rejected his application in the three -year limitation period for the compassionate appointment of Seijs, a rejection that was confirmed by a single Judge Bench of the Court.
By dismissing Gowdham’s appeal, the Division Bank made strong observations on the underlying system that led to such procedural obstacles. When observing how officials demanded fresh certificates despite having registered originals, the bank highlighted the observations made by a division bank of the Superior Court in P.Pappu vs. The Undersecretator, Rasipuram Sro, Rasipuram, Namakkal district, where judicial recognition was given to the fact that none of the certificates of government officials are priceless.
Regarding the present case, the Bank said: “By demanding the mother to obtain new certificates, the divisional engineer has only raided the way for the officers to issue said certificates obtain an illegal gratification once again.”
The Bank, therefore, emphasized: “We have to recognize that corruption is rampant in each government body today. Require a person to be compassionate to obtain three certificates once, sure, it is only the object of the object or illegitimate, it is certain that, those officers.”
He also regretted the Courts “helpless when stopping the threat of corruption.”
Conclusively, since Amudha had already requested in time and had tested all the necessary documentation, the Division Bank ordered the department to offer the compassionate appointment within four weeks, in line with its qualifications.
However, the decision of the only judge of the judge to reject the child’s request, arguing that it should have been submitted within three years. Since the son reached the majority only after the expiration of this limitation period after his father’s death, the request could not entertain himself.
