Couples marrying against parents’ wishes can’t claim police protection as right: Allahabad HC

The Superior Court of Allahabad has observed that couples who marry their will against their parents’ wishes cannot claim the protection of law unless there is a perception of real threat in their life and freedom.

The court gave the ruling to decide a request filed by a couple that seeks protection.

He said that the court can provide security to a couple in a deserving case, but in the absence of any perception of threats, a couple must “learn to support each one and face society.”

Judge Saurabh Srivastava made this observation while listening to a writing request filed by Shreya Kesarwani and her husband looking for police protection and an address so that private respondents do not interfere in their peaceful marriage life.

The Court, after going through the statements made in its request, eliminated from its request for writing, pointing out that there was no perception of serious threat to petitioners.

In addition, the court indicated that the petitioners did not submit a specific application in the form of information to the interested police authorities to present any FIR against the alleged illegal conduct of private respondents.

However, noting that the petitioners had already presented a representation to the Police Superintendent (SP), Chitrakot district, the court said: “In case the interested police find a true one to agree.” In this context, the court emphasized that if anyone behaves badly or manipulates them, the courts and the police authorities must go to their rescue.

In its decision dated April 4, the Court eliminated the declaration, arguing that the petitioners cannot claim security as a matter of character or right.
