On Tuesday, the Supreme Court withdrew the Superior Court of Allahabad for its comment, which suggests that a rape survivor had “invited problems and was responsible for it.”
Judge Sanjay Kumar Singh of the Superior Court of Allahabad made the comments on March 11 while granting the bond to a defendant arrested in December 2024 for allegedly violating a woman who had a bar in the Hauz Khas de Delhi area.
The Apex court criticized the horrible comment and urged the superior court judges to be “more careful” and sensitive in making statements in cases involving victims of sexual aggression.
A Bank of Judges Br Gavai and Agustín George Masih said that although granting the bail is at the discretion of the judge based on the facts of the case, unnecessary comments against the plaintiff should be avoided.
“Now there is another order from another judge. Yes, the bond can be granted. But, what is this discussion that ‘Sheerestelf invited problems, etc.?
“Complete justice should not only be done, but also consider. How a pure common person such orders should also be seen,” said General Tushar Mehta alone.

On March 26, the Supreme Court remained an order of the Superior Court of Allahabad, citing a “total lack of sensitivity” in the judge’s observations.
The Apex court said the ruling was not done in a hurry, but reflected a deeper inensibility. A bank that includes Judges Gavai and Masih expressed anguish for the comments and looked for answers from the center and government of Uttar Pradesh.
When the matter was tasks today for a greater hearing, the court published it next month. “Let the case be listed after 4 weeks. Let the service of the respondents be completed,” the bank directed.
