The Supreme Court on Wednesday (April 16, 2025) refused to entertain the requests presented by the National Research Agency (NIA) against the bond granted to 17 popular members of the Indian Front in the case of murder of Rsinivasan in the district of Kerala
A bank comprising Judges ABHAY S. Oka and N. Kotiswar Singh indicated that the order of the Superior Court of Kerala that grants the bond to the defendant is one year and the HC has the power to cancel the bond if the conditions are violated.
“Our attention is invited to the observation made in the last part of the contested order for which the Superior Court has reserved Liberty to the petitioners to request a special court for the cancellation of the bond.
“Therefore, petitioners can always request the Special Court for the cancellation of the bond in the reasons established in the affidavits presented in these requests. In fact, the Special Court will be the most appropriate court,” the bank said.
The Supreme Court said that the agency can satisfy the Special Court on the breach of the terms and conditions of bail concession through the production of materials against the accused.
“Therefore, at this stage we refuse to entertain special license requests with freedom to the petitioners to transfer the Special Court/Superior Court for the cancellation of the bond.
“We make it clear that, when the application is requested, for the cane of the bond, the Special Court or the Superior Court should not be influenced by the fact that the Court has refused to entertain the current special license requests,” the bank said.
Duration of the Hearing, the additional General Platition Raja Thakare, which appeared for the NIA, requested the cancellation of the bond and said that the defendants have violated the conditions of the bond and have contacted the witnesses.
The Superior Court of Kerala, on June 25, 2024, granted the bond to the 17 members accused of PFI, who also face a trial for allegedly instigating community violence in the state and other parts of the country.
With the bond to 17 of the 26 defendants, the Superior Court imposed strict conditions, which include sharing its cell phone numbers and GPS locations in real time with the investigating officer.
Apart from that, the defendants were ordered to leave Kerala, deliver their passports and keep their cell phones loaded and active during the day.
